Killian & Donohue, LLC counsels clients in all segments of the energy industry — crude oil and natural gas producers, service companies, gas marketers, large and small energy consumers, alternative energy producers such as wind farms and biomass and ethanol facilities, and independent electric power producers and marketers.
We routinely represent clients in state and federal courts, administrative proceedings and arbitrations involving energy issues. We have extensive experience litigating disputes involving electric deregulation, electric supply and marketing contracts, oil and gas lease royalty claims, drilling and operating agreements, gas purchase contracts, personal injury and wrongful death claims, and product liability issues. In addition, we regularly represent oil and gas clients in lien and collection matters, reorganizations, receiverships and bankruptcies.
We practice extensively before the Federal Energy Regulatory Commission, state utility commissions, the Department of Transportation, the Nuclear Regulatory Commission, and state and federal courts. We also engage in formal and informal alternative dispute resolution. We represent clients in administrative and judicial proceedings involving a wide range of electric issues, including regulated cost allocations and transmission rate design, challenges to market-based rate authority, mergers and acquisitions, NERC compliance and enforcement, and administrative rule-making proceedings.
Our natural gas practice encompasses nearly every aspect of the natural gas industry. We negotiate and enforce gas purchase and transportation contracts and represent clients before the FERC on matters involving transportation rates, rule-makings, NGA Sec. 5 complaints, contract enforcement, and pipeline certificate and tariff issues.
The firm’s hydroelectric and renewable energy practices include projects involving water, solar, wind, biomass and geothermal resources. Clients rely on us to help them plan, evaluate, site, permit and develop renewable energy projects across the nation. We negotiate interconnection agreements, joint ownership and development agreements, project operation agreements, purchase/sale agreements, and rights to renewable energy credits.
